General Terms and Conditions for Competitions Organised by labelfarm GmbH

1. Scope

At irregular intervals labelfarm ("organiser") promotes competitions on the pages of their Internet presence en.smow.ch ("website") and/or the respective official social media profile pages (Facebook, Instagram). In exceptional cases labelfarm involves a trusted third party in the organisation of a competition and is itself only existent as the prize sponsor. Participation in and the structure and organisation of the respective competitions is based on the following General Terms & Conditions, which the participant and, where relevant, any third party accepts as binding.

2. Eligibility and Conditions of Participation

Only persons of full legal age are entitled to participate. Participation and any subsequent prize allocation implies an explicit acknowledged these General Terms & Conditions.

Employees of labelfarm, smow or any other company associated with a particular competition are ineligible to compete.

Supplying false personal details, including invalid contact information - where necessary for the participation - will lead to exclusion from the competition. The same shall apply in the case of the transmitting discriminatory or unlawful messages.

Should labelfarm become aware of technical manipulation or a violation of these General Terms & Conditions the responsible party will be excluded from the competition. In such cases a prize win may be annulled and a replacement winner selected.

The competition begins with its publication on our websites, our official Social Media platform profiles or on a special website of a third party organiser. Participation in a particular competition is always according to the participation rules for the respective competition.

In order to participate in the contest, it is necessary for the competitor to correctly answer the relevant prize question on our website, our Facebook and/or Instagram account or the internet presence of a for the organisation of the competition co-opted third party within the period of the event, or to carry out an appropriately communicated action (for example, commenting or sharing a contribution).

Participation is only possible until the stated end of the relevant competition. Decisive for the time of entry is the recorded electronic protocol of the organiser's server. labelfarm accept no responsibility for any technical problems, which hinder a timely entry.

3. Prizes and Selection of Winners

In context of a specific competition one or more prizes can be awarded. Unless otherwise stated, only one prize will be awarded per participant. The organiser reserves the right to replace any stated prize with one of equal or higher value.

The winner/winners will be selected at random from amongst all valid participants. The winner/winners will be notified at the end of the competition via the relevant Facebook or Instagram accounts or via e-mail.

Notified winners are obliged to reply to the organiser within one month of the notification. If the respective winner does not register within this period, the prize win will be annulled and a replacement winner selected

Any consequential costs resulting from a win must be borne by the respective winner.

A cash alternative or an alternative prize is not possible. Prize rights cannot be transferred.

4. Responsibility

For prizes which are supplied by cooperation partners or prize sponsors, labelfarm is not responsible for a timeous and complete delivery of the prize, for any damage to the prize or for the insolvency of the partners and the resulting consequences for the prize.

As organiser of the competition labelfarm is only responsible for damage resulting from our employees or technical aids and which is caused deliberately or through negligence. As organiser of the competition labelfarm is not responsible for damage caused by problems with technical equipment, through transmission delays or for damage arising from participation.

Competitions run on the official smow social media networks Facebook or Instagram are no sense connected with Facebook or Instagram and is not sponsored, supported or organised by Facebook or Instagram. labelfarm are alone responsible and are the only contact point. All questions, comments or complaints about the competition are to be presented to labelfarm.

5. Data protection

In course of the competition personal data will be collected by the respective organiser. This data is required in order to run the competition, in particular competitors first name, family name, e-mail address - and in case of a win also a postal address - will be collected, saved and processed. In case of a win the organiser reserves the right to publish the winners name on our website and in our blog. In context of competitions where the prize is delivery is carried out by a third party, the organiser retains the right to communicate the contact data of the respective winner to the respective third party in order that that they can arrange said delivery. Through participation a participant expresses their acceptance of our Data Protection Policy.

6. Rights to transmitted content

The participant transfers irrevocably, and unrestricted temporally and geographically, all usage, exploitation and other rights necessary for the use and exploitation of content transmitted (e.g. texts, pictures, graphics, videos) in context of the respective competition. In particular, the organiser is entitled to disseminate the content and make it publicly available.

The participant waives all license fees in any form and stakes no claim t any form of remuneration.

The participant confirms that the transmitted content is their own work and does not violate intellectual property rights nor the rights of third parties.

7. Premature termination of the competition

In event of unforeseen circumstances the organiser reserves the right to change the competition, to prematurely end the competition or to discontinue the competition without awarding prizes. The final case is particularly valid in situations involving problems with software or hardware, or where other technical problems and/or legal conditions make a fair and regular organisation of the competition impossible.

8. General

The competition is exclusively governed by the laws of the Federal Republic of Germany. Recourse to the courts is excluded.
